1. Acceptance of Terms

By accessing or using Neighbheard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Neighbheard is a community-driven platform that allows users to rate and review residential addresses and neighborhoods based on their personal experiences.

3. Disclaimers for All Users (Including Viewers)

You do not need an account to view content on Neighbheard. However, by browsing and viewing content on the Service, you acknowledge and agree to the following:

User-Generated Content

  • All reviews, ratings, photos, and videos are submitted by users and do not represent the views or opinions of Neighbheard
  • We do not verify the accuracy of user-submitted reviews or claims made in content
  • Content is provided "as-is" without any warranties of completeness, accuracy, reliability, or suitability
  • Reviews reflect individual experiences and may not reflect your own experience or the current state of any location
  • We are not responsible for any decisions you make based on user-generated content on the Service
  • Neighbheard does not verify, endorse, or adopt any user content - User reviews represent personal opinions of individuals and not verified facts

No Endorsement

  • Neighbheard does not endorse, support, represent, or guarantee the accuracy of any user-submitted content
  • The presence or absence of reviews for any address does not constitute a recommendation or warning from Neighbheard

Moderation

  • We moderate content for prohibited material (harassment, personal information, illegal content, etc.)
  • Moderation does not verify truthfulness - it only removes content that violates our guidelines
  • The absence of moderation action does not imply accuracy or endorsement

Use at Your Own Risk

  • You rely on any information from this Service entirely at your own risk
  • We recommend conducting your own independent research and due diligence
  • Neighbheard is not liable for any decisions, actions, or consequences resulting from your use of information on the Service

No Real Estate or Investment Advice

Neighbheard does not provide real estate, housing, or investment advice. All content is informational and should not be relied upon for decisions relating to purchasing, renting, or investing in property. Consult with qualified professionals before making any real estate or financial decisions.

4. User Conduct (For Account Holders)

When using the Service, you agree to:

  • Provide accurate information: All reviews must be based on your personal, firsthand experience
  • Be respectful: No harassment, hate speech, or personal attacks
  • Protect privacy: Do not share personal information (PII) about yourself or others
  • STRICTLY NO DOXXING: Do not reveal private information about individuals or residents. Doxxing violations may be reported to law enforcement authorities.
  • Own your content: Only upload photos and videos that you own or have permission to use
  • Be honest: Do not post false, misleading, or defamatory content

5. Prohibited Content

You may not post content that:

  • Contains personal information (names, phone numbers, emails, etc.)
  • Uploading content with personal information (PII) may result in immediate account termination and may be reported to law enforcement or affected individuals
  • Is defamatory, threatening, or harassing
  • Violates any laws or regulations
  • Infringes on intellectual property rights
  • Contains malware or malicious code
  • Is spam or commercial advertising

6. Content Moderation

We reserve the right to:

  • Review, moderate, or remove any content at our discretion
  • Suspend or terminate accounts that violate these terms
  • Use automated systems to detect prohibited content
  • Report illegal content to authorities

6.1 Doxxing and Law Enforcement Reporting

We take doxxing extremely seriously. Doxxing—the act of revealing private or identifying information about individuals without their consent—is strictly prohibited and may constitute illegal activity under various federal and state laws.

We reserve the right to:

  • Immediately remove any content that contains doxxing or attempts to identify individuals
  • Permanently ban users who engage in doxxing behavior
  • Report doxxing incidents to law enforcement authorities, including but not limited to local police, the FBI, and other relevant agencies
  • Preserve and provide evidence of doxxing to law enforcement upon request
  • Cooperate fully with any criminal investigations related to doxxing
  • Disclose user information, including IP addresses, account data, and content, to law enforcement, affected individuals, or their legal representatives if we reasonably believe a user has engaged in doxxing, harassment, threats, or other harmful conduct

Doxxing may include, but is not limited to:

  • Posting names, addresses, phone numbers, or email addresses of residents
  • Sharing employment information or workplace details
  • Revealing vehicle information, license plates, or parking locations
  • Posting photos that identify individuals or their property in a targeted manner
  • Any attempt to enable harassment, stalking, or threats against individuals

If you witness doxxing on the platform, please report it immediately through the flagging system or contact us at support@leadsong.com.

6.2 Moderation Decisions

Neighbheard's content moderation decisions are final and made at our sole discretion. We have no obligation to display, maintain, or restore any content that has been removed or rejected. Users may appeal moderation decisions by contacting support, but we reserve the right to make final determinations on all content matters.

7. User Content and Ownership

By posting content, you grant us:

  • A non-exclusive, worldwide license to display and distribute your content
  • The right to moderate and remove content
  • Permission to use content for improving the Service

You retain ownership of your content but are responsible for its accuracy and legality.

7.1 Deletion and Retention of User Content

User Rights:

  • Users may delete or unpublish their own reviews through their account or by contacting us.
  • When a review is deleted, it will be removed from public display but may be retained internally for moderation, legal, or compliance reasons.

Internal Retention:

  • We reserve the right to store, review, or disclose retained content if required by law or necessary to enforce these Terms.
  • Retained data is used only for purposes such as investigating abuse or fraud, complying with legal obligations, enforcing our Terms of Service, or maintaining service integrity and security.
  • Retained data is deleted or anonymized after 12 months unless needed for ongoing legal compliance, abuse prevention, or law enforcement purposes.

Content Removal:

  • Deleted content will no longer be visible to other users or appear publicly on Neighbheard.
  • However, a copy may be retained in our internal systems for a limited period as described above.

8. GPS Verification

The Service may request your location to verify on-site reviews. Location data is used solely for verifying on-site activity and is not stored beyond the verification process. GPS coordinates are immediately deleted after verification is complete. Only a verification status flag (GPS Verified badge) is retained.

9. Privacy

Your use of the Service is subject to our Privacy Policy. We collect and use data as described in that policy.

10. Intellectual Property

All content and materials on the Service (excluding user-generated content) are owned by us or our licensors and protected by copyright and trademark laws.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT.

12. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

LIABILITY CAP: In no event shall our total liability to you for all claims arising from or related to the Service exceed the greater of (a) $100 USD or (b) the amount you paid to use the Service in the past 12 months. Since the Service is provided free of charge, the maximum liability is $100 USD.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

14. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice.

16. Governing Law and Venue

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Exclusive Venue: Any dispute, claim, or controversy arising under these Terms shall be resolved exclusively in the state or federal courts located in Santa Clara County, California. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
